Image licensing
Every photograph and motion asset on this site is copyright Brent Herrig Photography LLC. Nothing here is stock. Usage is licensed per project, and the terms are agreed in writing before a shoot begins.
What a license covers
A license is permission to use specific images in specific ways. It is separate from the production fee, which pays for making the pictures. Clients own the usage they license. Copyright in the images stays with Brent Herrig Photography LLC unless a written buyout says otherwise.
Every license is written against four things:
- Media. Where the images run: paid social, web, out of home, print, packaging, editorial, internal.
- Territory. Which markets: one country, a region, or worldwide.
- Term. How long the usage runs, most often one, two, or three years from first use.
- Exclusivity. Whether the images can appear in other work during the term, and in which categories.
Renewals and extensions are normal. If a campaign performs and you want to keep running it, the term can be extended without a reshoot.
What is not included by default
Unless the agreement says so in writing, a license does not include resale or sublicensing to third parties, use by a parent company or sister brand, use as a trademark or logo, or use as training data for machine learning models. Talent, property, and location releases carry their own limits, and those limits sit on top of the license.
Using an image you found on this site
Portfolio images are published to show the work, not to be reused. Downloading, reposting, or running any image from this site in your own material needs a license first. That includes editorial and press use, which is usually straightforward to clear and often free, but still needs a request.
If an image is already published somewhere with credit and you want to reuse it, say where you saw it. It makes the request faster to answer.
Credit
Credit reads Brent Herrig. Where a credit line is possible, include it. Where it is not, such as most paid placements, the license still stands and no credit is required.
Who holds the rights
Copyright sits with Brent Herrig Photography LLC, a New York company. Work produced in the UK and Europe may be contracted through Brent Herrig Creative LTD. Licensing terms are the same either way, and the contracting entity is named on the agreement.
Request usage
Send the images you want, where they will run, which markets, and for how long. A quote comes back against those four points.
